Terms of use for patients

Version 2026-10 · Planned effective date 2026-11-01 · Versión en español · All legal documents

Draft pending review by a lawyer. This text describes what the product does today; it is not legal advice and may change before final publication.

These are the rules for using your clinic’s booking page, patient portal and assistant: what the assistant does, what it does not do and what your rights are.

1 · 1. Who these terms are for

These terms are for you if you use the booking page, the patient portal, the WhatsApp or voice assistant, or an intake form of a clinic that uses Soluciones para Doctores.

The clinic is the one who treats you. Tsunami Automation Global LLC only provides the software the clinic uses to schedule, remind you of your appointments and prepare your care. We are not your doctor or a health institution. Each clinic also has its own policies (for example, on cancellation or deposits).

2 · 2. The automated assistant

You talk to an automated assistant that uses artificial intelligence. It helps with administrative tasks: booking, changing or cancelling an appointment, giving clinic information (hours, services, location, policies), sending reminders and collecting your details before the visit.

  • It does not give medical advice. It does not diagnose, recommend treatments or medicines, or interpret tests.
  • It can make mistakes. Always check the date, time and place of your appointment in the confirmation.
  • You can ask to talk to a person at any time. Write, for example, “I want to talk to a person”.

3 · 3. If it is an emergency

If you or someone else is in danger, call 911 or go to an emergency room. Do not use the chat, the call with the assistant or the booking page for an emergency.

If you write something that looks urgent or clinical, the assistant answers with emergency guidance and alerts the clinic’s team. But the team may not read it right away. Do not wait for their reply.

4 · 4. Your data and who is responsible for it

Give true and up-to-date details (name, phone, email, reason for the visit). If they are wrong, you may not receive important notices.

The clinic is responsible (controller) for your personal data. We process it on the clinic’s behalf. Before collecting your data, the clinic must give you its privacy notice. Our notice (/privacidad) explains how we handle data that we are responsible for, such as data of people who visit the site.

What you write to the assistant is sent to a language-model provider in the United States to prepare the reply. WhatsApp messages go through Meta. WhatsApp voice notes are sent to that provider to turn them into text. So in the chat, write only what you need for your appointment and talk about the details of your health with the clinic. The list of providers is at /legal/en/subencargados.

Legal basis: LFPDPPP (DOF 20-mar-2025), art. 15 y art. 16; LFPDPPP (DOF 20-mar-2025), art. 2 fr. XII y XIV

5 · 5. Your consents

Your health data is sensitive data. The clinic may only process it with your express consent. The intake form has a required checkbox to give that consent. It records the date, the version of the text you accepted, your IP address and your device.

  • You can refuse. But then the clinic may not be able to prepare your care through this channel.
  • You can withdraw your consent later by asking the clinic. Withdrawal does not change what was already done.
  • The clinic’s promotions and news are only sent if you tick the marketing checkbox. It is a separate box, it is optional and it does not affect your care. To stop them, reply BAJA, ALTO or STOP on WhatsApp, or tell the clinic.
  • If you reply BAJA, ALTO or STOP, you stop receiving any WhatsApp message from the clinic through the platform, including appointment reminders. Keep track of your appointment date. If you later write something urgent, we may answer with emergency guidance.

Legal basis: LFPDPPP (DOF 20-mar-2025), art. 7, art. 8, art. 26; Reglamento de la LFPDPPP (2011), arts. 19 y 20

6 · 6. Appointments, cancellations and reminders

Each clinic sets its own hours, cancellation rules, deposits and reminders. We do not set them. If the clinic asks for a deposit or a payment, that deal is between you and the clinic. The clinic gives you its receipt.

Reminders arrive by WhatsApp, email or another channel, depending on what the clinic uses. They can fail (for example, if your phone is off or your number changed). You are responsible for remembering your appointment. If you cannot attend, cancel or change the appointment in good time.

7 · 7. Personal links

Some links you receive (for the intake form, the portal or managing an appointment) contain a personal key. Anyone who has the link can see or change your information. Do not share or forward it.

Links expire: the intake link after 7 days and the portal link after 30 days. The clinic can send you a new one. If you think someone else received your link, tell the clinic.

8 · 8. Calls with the voice assistant

A call with the voice assistant may be recorded and transcribed by our voice provider. When the clinic switches the notice on, the assistant tells you at the start of the call. Even so, keep in mind that the call may be recorded.

The provider keeps the audio and the transcript until they are deleted. If you do not want your call recorded, do not use the voice line: contact the clinic another way. You can ask for a recording to be deleted (section 12).

9 · 9. Minors

If the appointment is for a person under 18, the booking and the consents are given by a parent or guardian. The clinic may ask you to confirm it.

The 2025 personal data law has no specific article on minors. That is why we ask a responsible adult to always accept.

10 · 10. Proper use

Do not use these services to:

  • pretend to be someone else or book false appointments;
  • send offensive messages, threats or spam to the assistant or to the team;
  • try to see other people’s data, bypass security controls or overload the system.

The clinic may cancel appointments or block access if there is abuse.

11 · 11. Liability

Medical care is the responsibility of the clinic and its professionals, not of Tsunami Automation Global LLC. We are responsible for what falls to us under the law, for example protecting the data we process on the clinic’s behalf.

The tools can have faults or interruptions (for example, from WhatsApp or the network). Nothing in these terms limits the rights the law gives you that cannot be waived.

Legal basis: LFPDPPP (DOF 20-mar-2025), art. 53

12 · 12. Your rights over your data (ARCO)

You have the right to access your data, rectify it, cancel it and oppose its processing (ARCO rights). You can also oppose decisions made only by an automated system that significantly affect you. The assistant does not decide on your medical care and you can always ask for a person.

Ask for your rights from the clinic, which is the controller. If you write to privacy@tsunamiautomation.com, we send your request to the clinic. The clinic answers within 20 business days and, if it applies, carries it out within 15 more business days. It is free; they can only charge for copies or shipping.

Cancellation (deleting your data) is currently done by a manual procedure. The clinic may refuse it if it must keep your clinical record (the standard requires at least 5 years from your last visit). If your voice call was recorded, you can ask for the recording to be deleted. Mexican law has no right of portability, but you can ask for a copy through the right of access.

If you think your rights were not respected, you can go to the Secretaría Anticorrupción y Buen Gobierno.

13 · 13. Changes and governing law

We may update these terms. The current version is always on this page. If a change affects you in an important way, we tell you.

These terms are governed by the laws of Mexico.
